1. Acceptance of Terms

By accessing or using FinallyMet ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our service.

2. Description of Service

FinallyMet is a dating and matchmaking service that operates primarily through SMS, iMessage, and messaging platforms. We provide:

  • AI-powered matchmaking based on user profiles and preferences
  • Weekly curated match recommendations
  • Facilitated introductions between compatible users
  • Optional payment for successful connections (pay-what-you-want model)

We do not guarantee any specific outcomes, including but not limited to successful matches, dates, or relationships.

3. Waitlist

By joining our waitlist, you:

  • Consent to provide your email address for the purpose of receiving launch notifications and service updates
  • Acknowledge that your email will be stored in our database as described in our Privacy Policy
  • Agree to receive email communications from FinallyMet (you may unsubscribe at any time)
  • Understand that joining the waitlist does not guarantee early access or any specific benefits

4. Eligibility

To use FinallyMet, you must:

  • Be at least 18 years of age
  • Have the legal capacity to enter into a binding agreement
  • Not be prohibited from using the service under applicable laws
  • Provide accurate and truthful information in your profile

5. Account Registration

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to:

  • Provide accurate, current, and complete information
  • Update your information to keep it accurate
  • Notify us immediately of any unauthorized use of your account
  • Not create multiple accounts or accounts for others

6. User Conduct

You agree not to:

  • Use the service for any unlawful purpose
  • Harass, abuse, or threaten other users
  • Send spam, solicitations, or promotional content
  • Impersonate another person or misrepresent your identity
  • Upload false, misleading, or significantly outdated photos
  • Share explicit, offensive, or inappropriate content
  • Use the service for commercial purposes without authorization
  • Attempt to circumvent any security features
  • Scrape, crawl, or collect data from our service

We reserve the right to terminate accounts that violate these guidelines without notice or refund.

7. Content Guidelines

Photos

Photos you upload must:

  • Be recent (within the last 2 years) and accurately represent your current appearance
  • Show your face clearly in at least one photo
  • Not contain nudity, explicit content, or offensive material
  • Not include other people's faces without their consent
  • Be photos you own or have the right to use

Profile Information

All information you provide must be truthful and accurate. Misrepresenting your age, location, or other key details may result in account termination.

8. Matching and Connections

Our matching system uses AI to suggest compatible partners based on your profile and preferences. We do not guarantee:

  • The accuracy or quality of any match
  • That matches will result in mutual interest
  • Any specific outcome from connections
  • The truthfulness of other users' profiles

When you and another user both express interest in each other, we may share your contact information (phone numbers) to facilitate direct communication. By using the service, you consent to this sharing in the event of mutual interest.

9. SMS/Text Messaging

By providing your phone number, you consent to receive text messages from FinallyMet including:

  • Verification codes
  • Match notifications
  • Service updates
  • Follow-up messages about your experience

Message frequency varies. Message and data rates may apply. You can opt out at any time by replying STOP. For help, reply HELP or contact [email protected].

10. Payments

FinallyMet operates on a pay-what-you-want model for successful connections. This means:

  • The service is free to use
  • After a successful connection, you may choose to pay an amount that reflects the value you received
  • Payments are voluntary and non-refundable
  • We may send payment reminders, which you can opt out of at any time

Payments are processed through Stripe. By making a payment, you agree to Stripe's terms of service.

11. Intellectual Property

The FinallyMet name, logo, website, and service are owned by us. You may not use our branding without permission. Content you create (photos, text) remains yours, but you grant us a license to use it for operating the service and matching purposes.

12. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

WE MAKE NO GUARANTEES ABOUT THE CONDUCT, IDENTITY, OR INTENTIONS OF OTHER USERS. YOU ARE SOLELY RESPONSIBLE FOR YOUR INTERACTIONS WITH OTHER USERS.

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FINALLYMET SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE.

OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU HAVE PAID TO US IN THE PAST 12 MONTHS, OR $100, WHICHEVER IS GREATER.

14. Safety

Your safety is important. When meeting someone in person:

  • Meet in a public place for the first few dates
  • Tell a friend or family member your plans
  • Arrange your own transportation
  • Trust your instincts-if something feels wrong, leave

15. Termination

You may terminate your account at any time by contacting us at [email protected]. We may suspend or terminate your account if you violate these terms, engage in harmful behavior, or for any other reason at our discretion.

16. Changes to Terms

We may update these Terms of Service from time to time. Changes will be posted on this page. Continued use of the service after changes constitutes acceptance of the updated terms.

17. Indemnification

You agree to indemnify, defend, and hold harmless Explode LLC, its officers, directors, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising out of or related to:

  • Your use of or access to the Service
  • Your violation of these Terms
  • Your violation of any rights of another person or entity
  • Your interactions with other users, whether online or offline
  • Any content you submit to the Service

18. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Wyoming, United States, without regard to its conflict of law provisions.

19. Dispute Resolution and Arbitration

PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS, INCLUDING YOUR RIGHT TO FILE A LAWSUIT IN COURT.

You and Explode LLC agree that any dispute, claim, or controversy arising out of or relating to these Terms or the Service shall be resolved through binding arbitration administered by the American Arbitration Association ("AAA") in accordance with its Consumer Arbitration Rules.

The arbitration will be conducted in the English language. The arbitrator's decision will be final and binding, and judgment on the award may be entered in any court of competent jurisdiction.

Class Action Waiver

YOU AND EXPLODE LLC AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING. Unless both you and Explode LLC agree otherwise, the arbitrator may not consolidate more than one person's claims and may not otherwise preside over any form of a representative or class proceeding.

Exceptions

Notwithstanding the above, either party may seek injunctive or other equitable relief in any court of competent jurisdiction to prevent the actual or threatened infringement or misappropriation of intellectual property rights.

20. Severability

If any provision of these Terms is held to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect. The invalid or unenforceable provision shall be modified to the minimum extent necessary to make it valid and enforceable while preserving the original intent of the parties.
